These terms of use govern your use of the apps PassportPhotoPrintHero (Standard) and PassportPhotoPrintHero Pro (together “the App”) and of this website. The provider is foto-huwi.ch Huwiler, Signalstrasse 17, 9400 Rorschach, Switzerland (“we”, “us”).

1. Scope and license

The App is offered exclusively through the Mac App Store operated by Apple Inc. The license is governed by Apple's Licensed Application End User License Agreement (standard EULA). These terms supplement it. By downloading, installing or using the App, you agree to both.

2. What the App does

The App creates passport photos and print sheets at actual size: face detection and automatic alignment, background replacement, image adjustments, saving to a file and printing. The Standard edition (PassportPhotoPrintHero) includes a selection of photo and paper formats; the Pro edition (PassportPhotoPrintHero Pro) includes all formats plus additional features such as two photos on one sheet and editing custom formats. The “Pro Upgrade” in-app purchase gives the Standard edition the same scope as the Pro edition. The current scope is described on the Mac App Store product page and on this website. The App requires macOS 14 Sonoma or later.

3. Purchase, prices and refunds

You buy the App and the Pro upgrade from Apple. Prices, payment, invoicing and any refunds are subject to the terms of the Mac App Store. You can request a refund directly from Apple at reportaproblem.apple.com. We do not process any payments ourselves.

4. Photo requirements and acceptance by authorities

The dimensions included in the App come from official sources or follow the standard of the International Civil Aviation Organization (ICAO). They are carefully maintained but may change at any time. Whether a passport photo is accepted is decided solely by the responsible authority, also based on criteria such as expression, lighting, sharpness, head position and background. Please check the authority's current requirements before printing. Some authorities do not allow edits beyond simple corrections, such as a replaced background. We do not guarantee that photos created with the App will be accepted.

The print result depends on the printer, paper and print settings. Check the size on a test print and, if necessary, compensate for deviations with print scale correction. Automatic results such as alignment and background removal should be reviewed before printing.

5. Your responsibilities

• You only use photos for which you hold the necessary rights and obtain consent from other people whose photos you edit.
• You comply with applicable data protection law when editing portraits of others.
• You do not use the App for unlawful purposes, in particular not to deceive authorities or to forge identity documents.

6. Intellectual property

The App, including its design, code, texts, graphics and format data, is protected by copyright and owned by foto-huwi.ch Huwiler. To the extent permitted by law, you may not copy, modify, distribute or reverse-engineer the App. The photos you create with the App belong to you.

7. Warranty

We develop the App with care and fix reported bugs through updates where possible. However, we cannot guarantee that the App will always work without errors or interruptions or with every hardware and software configuration. Mandatory statutory warranty rights, in particular those of consumers, remain unaffected.

8. Liability

We are liable without limitation for damage caused intentionally or through gross negligence and under mandatory statutory provisions. Otherwise, to the extent permitted by law, our liability is excluded – in particular for indirect or consequential damage, lost profits and costs arising from the rejection of a passport photo by an authority.

9. This website

The content of this website provides information about the App. We strive to keep it accurate and up to date but give no guarantee. The operators of linked third-party websites are responsible for their content.

10. Changes

We may update these terms, for example when adding features or when the legal situation changes. The version published on this website applies. In case of discrepancies between the German and the English version, the German version prevails for users in Switzerland and the EU.

11. Governing law and jurisdiction

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Rorschach, Canton of St. Gallen, Switzerland. Mandatory jurisdictions and protective provisions in favor of consumers, in particular at their place of residence, remain reserved.
